The formal civil litigation process involves filing and serving the other party with a summons and complaint. This initiates a civil lawsuit. The complaint should be a concise statement of the harm caused by the other party and the damages incurred. Once a complaint is filed, the other party (now formally the defendants) is obligated to respond, and if the court does not initially dismiss it as defective, discovery (exchange of documents and testimony) takes place. If the case remains unsettled at that juncture, it will proceed to trial.
